Abstract

“Standard form contracts” or “contracts of adhesion” contain pre-fixed terms which are prepared in advance and used for the repeated use by companies supplying goods or services. Despite their advantages, in many situations they have been used to impose extra obligations upon the customers or to limit the responsibility of the party providing
the standard contract form its contractual obligations, or limit the responsibility of the darfting party. This article provides how common law deals with standard form contracts, at time named as “contracts of adherion”. In both US and English legal system, common law courts have been established certain grounds for their policing such contracts. In addition, in England certain statues have been enacted to specifically deal with the problem of standard form contracts.
