In recent years primacy has been given to the place of human rights and international humanitarian law. The international instruments such as the charter of the United Nations, the universal declaration of human rights and Geneva conventions of 1949 have recognized fundamental and basic rights of man during peace and war.
However, the rights of palestinian people for more than half a century are forcibly prevented from existing by Israel as an occupier. The purpose of this paper is to concentracte on the legal aspects of the grave breaches of the rules of human rights and international humanitarian law in palestine, and the ways to ensure and to enhance the respect for international legal rules for the benefit of the palestinian people.
