Law and the Criminal Procedure in thE_ Law of the General and
Revolution Courts
Although the defensive rights of the accused, has been guaranteed, both by the Constitution of the Islamic Republic of Iran
and the International Convenant on Civil and Political Rights at the different stages of a trial, no effective step has been taken in
ordinary laws. Recently enternd into force, the criminal procedure in the law of the General and Revolution Courts takes into accout the
necessity of certain defensive rights of the accused, while being invested by police in explicit crimes; Those rights include: Informing
the acaused of his accusation in written, which has to be occured immediately after the accused "being placed under control"; and its
reasons should be mentioned. But at the preliminary stage, in its strict sense, which is one of the important stages in the criminal
trial, these rights is become irrationally limited; This is because of compulsory and temporary apprehensions being added, and the
right for the investigating judges, who can prevent the attorney from being present in the investigation sessions, wehre they find the
possibility of "corruption".
